Every year millions of cars and trucks are wrecked, burned and damaged by floods. While many of the repairable cars are satisfactorily rebuilt and
returned to use, a large percentage of total loss vehicles are rebuilt and sold to unsuspecting consumers every year. Fortunately, most states have lemon law statutes that allow us to seek redress in these dealer fraud
cases. Unlike most consumer transactions, the burden usually falls on the car dealer
to disclose known defects and to be vigilant with regard to a car's safety, origin and quality. Consumer laws are such that auto dealers are held to a higher standard than a private seller is. In fact, one can be found liable for selling cars with defects---even those one knew nothing about. It is a question of what they
should have known. |
